General Terms and Conditions – Luna & Chloé Miami
Article 1 – Definitions
For the purposes of these General Terms and Conditions, the following definitions apply:

Withdrawal Period: The period during which the Consumer may exercise their right to cancel the contract.

Consumer: An individual who is not acting in the course of a trade, business, or profession, and who enters into a Distance Contract with the Business.

Continuous Contract: A Distance Contract for a series of products or services where obligations are carried out over time.

Right of Withdrawal: The option for the Consumer to cancel a Distance Contract within the Withdrawal Period.

Business: An individual or legal entity offering products or services at a distance to Consumers.

Distance Contract: A contract concluded between the Business and the Consumer via distance communication technology.

CESOP: Central Electronic System of Payment Information introduced by the European Union to monitor payment service providers.

Article 3 – Scope of Application
These General Terms and Conditions apply to all offers made by the Business and to any contract concluded at a distance between the Business and the Consumer.
Before finalizing a contract, these Terms and Conditions will be made available to the Consumer electronically or by other means.
Article 4 – Offers

All offers are non-binding. The Business reserves the right to amend or withdraw offers at any time.

All offers will clearly state the total price, including shipping fees, customs duties, and any additional postal or courier charges.
Article 5 – Agreement

An agreement is concluded when the Consumer accepts the offer and meets the conditions set out therein.

Upon acceptance, the Business will promptly confirm the order by email.
Article 6 – Right of Withdrawal

The Consumer has the right to withdraw from the contract within 14 calendar days from the day the product is received, without providing a reason.

The Consumer is responsible for the cost of return shipping when exercising the Right of Withdrawal.
Article 7 – Costs in Case of Withdrawal
The Business will refund all payments received from the Consumer within 14 calendar days of receiving the returned product, provided it is in its original condition and packaging.
Article 8 – Customs and VAT

The Consumer is solely responsible for complying with all legal obligations related to the import of goods into their destination country, including but not limited to customs fees, taxes, and clearance charges.

The Business is not the official importer of products shipped to customers outside of the United States. The Consumer must ensure compliance with local import regulations for purchased goods.

Any additional costs related to customs clearance, including administrative fees imposed by postal or courier services, are the sole responsibility of the Consumer.
